Conditional Use

A Conditional Use is a use that may be compatible with the zoning designation but a review of the impacts of the proposal is required by the Planning Commission for compliance with adopted standards in the Land Development Code. Examples include a school or a church in a residential neighborhood. Each zoning designation includes a list of Conditional Uses specific to that zone.

In addition to the zoning designation the following chapters of the Land Development Code (LDC) are applicable to Conditional Use requests:

 

Review Process

Conditional Use requests are processed as a Type III Land Use application. The process starts with a pre-application conference to provide feedback on a proposal and the information necessary to submit a complete land use application. Once an application is submitted, it is reviewed for completeness purposes within 30 days. Per State law, once complete, a decision from the city is provided within 120 days. Type III decisions include a staff recommendation and a decision by our 7-member Planning Commission.

Some likely applications and fees are identified below, though depending on the specifics of the application additional information may be required from the Planning Division, other departments, agencies, and consultants.
